** If you would like to ride with a friend in the same group on track, you must indicate that below on your sign up. We have to know prior to your school date. We can’t guarantee you will be able to ride with your friend but if we don’t know about it before hand we will not be able to accommodate this request at the track.**

Refund, Reschedule And Cancellation Policy

We are very strict about our cancellation policy. You will find our Policy is standard industry practice among car and motorcycle schools. The following applies to any and all reasons for cancelling OR rescheduling, including accidents, missed travel connections, bike malfunctions, acts of God, health issues, work or personal emergencies, you name it.
1. Your school deposit locks in your spot.
2. If you cancel or reschedule 15 days or more before your scheduled date(s) , you get a full refund*.
3. If you cancel or reschedule between 8 to 14 days before your scheduled date(s ) you will lose your deposit.
4. If you cancel between 0 to 7 days before your scheduled date(s ) you will lose your entire school fee, this includes "no shows" on the day of the school.
There are no exceptions to the above.
*All refunds are subject to a 3% re-credit service fee.

ACKNOWLEDGEMENT OF DANGER

AND

RELEASE FROM LIABILITY

The Released Parties expressly waive and relinquish all rights and benefits afforded by Section 1542 of the Civil Code of the State of California, and understand and acknowledge the significance of such specific waiver of Section 1542. Section 1542 of the Civil Code of the State of California states as follows:

"A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR."

Thus, notwithstanding the provisions of Section 1542, and for the purpose of implementing a full and complete release and discharge of the Released Parties, the Released Parties expressly acknowledge that this Agreement is intended to include in its effect, without limitation, all Claims which the Released Parties do not know or suspect to exist in their favor at the time of execution hereof, and that this Agreement contemplates the extinguishment of such Claim(s).

I recognize that I may be injured or killed as a result of my own or someone else's negligence, either active or passive or by an equipment failure of the sort which would permit suit against a manufacturer or supplier on a theory of strict (product) liability.

BY SIGNING THIS AGREEMENT I, _____________________________________________, INTEND TO RELEASE, INDEMNIFY, AND HOLD HARMLESS THE CALIFORNIA SUPERBIKE SCHOOL, INC., ALL OF ITS AGENTS, OFFICERS, EMPLOYEES, LANDOWNERS AND FACILITY OPERATORS, AND ALL OTHER PARTICIPANTS IN SCHOOL ACTIVITIES FROM ANY LIABILITY FOR ANY NEGLIGENCE WHICH RESULTS IN INJURY TO ME, WHETHER SUCH NEGLIGENCE IS ACTIVE OR PASSIVE. I ACCEPT AND USE ALL EQUIPMENT FURNISHED TO ME BY CALIFORNIA SUPERBIKE SCHOOL "AS IS," WITH ANY DEFECTS, WHETHER APPARENT OR NOT. I INTEND TO RELEASE CALIFORNIA SUPERBIKE SCHOOL AND ALL ITS EQUIPMENT SUPPLIERS FROM ANY STRICT OR PRODUCT LIABILITY FOR MY INJURY OR DEATH.

WHAT'S MORE, BY SIGNING THIS AGREEMENT AND PARTICIPATING IN ACTIVITIES AS A STUDENT OF THE CALIFORNIA SUPERBIKE SCHOOL, INC., I ACKNOWLEDGE THAT I AM PREPARED TO TAKE MY CHANCES OF INJURY OR DEATH, AND TO ASSUME THE RISK THAT I MAY BE INJURED OR KILLED WHILE PARTICIPATING IN SCHOOL ACTIVITIES.

In California, a person is passively negligent when he merely fails to act under circumstances where he is required by law to do so; and on the other hand a person may be actively negligent either by doing some act or by participating in some manner in some kind of conduct of omission which caused an injury (for example, a decision made by school staff not to place a flag man at a spot where a collision later occurs), or by failing to perform a precise duty which that person had agreed to perform.

A manufacturer or supplier of defective products may be held strictly liable for injury caused by the product even if such manufacturer or supplier is not negligent.

Because laws regarding negligence and liability are different from state to state, and country to country, I understand and agree that any legal action involving this release, or its effect, shall be governed by the laws of the State of California, regardless of the place of injury of death, or location or jurisdiction of any court in which such an action is brought.

I know that I must read, and understand and sign this Contract before I may participate in any of the activities of the California Superbike School, Inc., at _____________________________, or elsewhere. I also know that if I do not wish to sign this agreement, and participate in school activities, that anytime up until one (1) working day prior to the actual school date, I am entitled to a full refund of any tuition of fees which i have paid, less, but not exceed, a $50.00 processing charge for administration costs I have incurred and/or preparation of equipment for my use.

Rain or Shine: We run rain or shine. Most tracks have excellent traction and can be run in wet conditions, besides it doesn’t usually rain all day. We’ll be there and so should you. If the conditions are so bad we can’t run at all or we have to stop, you will get a full or partial rain-check to reschedule for another school.

Riding Experience: Participants must have some riding experience—we do not train first time riders.

Crashing: Crashing can end a participant’s day of track riding. We aren’t doctors and can not OK riders to return to track activities if they crash. There are exceptions.

Compliance with Safety Procedures: Participants agree to comply with CSS staff as regards safety procedures, failure to comply can lead to expulsion from school activities.

Consecutive Days of Training: In the event that you are signed up for 2 or more consecutive school days, you will be responsible for attending both or all days as per our normal cancellation & reschedule policy. This includes but is not limited to personal schedule change, mechanical failure if riding your own bike, crashing, etc.

Payment of School: Your school date(s) must be paid in full 30 days before the school date(s). If the balance due is not received by this time it may result in a forfeiture of your reserved spot. CSS has the right to give this spot to someone else and refund any monies previously paid by you.

Paying for a Friend: If you pay for the deposit on a spot at the school for a friend, you are liable for the full payment of the school 30 days before the school date(s) as if the spot was yours. If you decide not to pay for his/her balance you are solely responsible for getting your friend to pay it 30 days before the school date(s).

Renting a BMW S1000 RR: This is only for those participants that are renting one of the school’s S1000 RRs, you must have a valid motorcycle license, it does not have to be from the state that you are attending the school in.

Equipment & Parts Replacement: All participants are responsible for the repair or replacement of our equipment and parts for any of the following: Our bikes, including training bikes, riding gear and timing transmitters that may have been lost or harmed while in your use. For our schools, you will be liable up to $6000 for our bikes. You are liable up to $300 for damage to our riding gear, timing equipment and/or on-board camera. Please bring cash, check, money order or a credit card (MasterCard, or Visa) with availability; to the track on the day of the school should the above occur.
